Terms and conditions

These terms govern membership of Kraftraum Hamborn GmbH, Kaiser-Wilhelm-Straße 288, 47166 Duisburg. They are handed to every member in writing at the counter and apply from 1 January 2026.

§1 Scope

These terms apply to all membership and day-pass agreements between Kraftraum Hamborn GmbH (the operator) and its members. Deviating terms of the member only apply if the operator has agreed to them in writing.

§2 Formation of the contract

A membership contract comes about when the member signs the membership form at the counter and the operator countersigns it. Contracts are not concluded over this website; the trial form is an enquiry only and creates no obligation on either side. Members must be at least 16 years old; members under 18 need the written consent of a legal guardian.

§3 Fee and payment

The membership fee is €19,90 per calendar month including statutory VAT. There is no joining fee, activation fee or service charge. The fee is collected by SEPA direct debit on the first working day of each month from the account named by the member. A locker costs an additional €3 per month; a day pass costs €7. If a direct debit is returned for a reason the member is responsible for, the bank charges incurred are passed on.

§4 Term and cancellation

The contract runs for one calendar month and renews automatically by one month unless cancelled. Either party may cancel with four weeks notice to the end of a calendar month. Cancellation must be in text form; a note at the counter or an email to moin@kraftraum-hamborn.de is sufficient. The operator confirms every cancellation in text form. The right to extraordinary termination for good cause remains unaffected.

§5 Suspension

Members may suspend their membership free of charge for up to three months per calendar year on presentation of a medical certificate. The contract term is extended by the period of suspension.

§6 Access and gym rules

Access is by personal membership card at the turnstile. The card is not transferable. Members must follow the gym rules displayed at the entrance: indoor training shoes, a towel on every bench and machine, and weights returned to the rack after use. The operator may exclude members from the premises for serious or repeated breaches, and may terminate the contract for cause.

§7 Health

Members train on their own responsibility. By signing, the member confirms that no medical condition is known to them that speaks against strength training. The operator recommends a medical check-up before starting, particularly for members over 35 or returning after a long break. Staff on the floor give technique instructions but do not provide medical advice.

§8 Liability

The operator is liable without limitation for damage arising from injury to life, body or health caused by a negligent or intentional breach of duty, and for other damage caused by intent or gross negligence. For slight negligence the operator is liable only for the breach of a material contractual obligation, and then limited to the foreseeable damage typical of this type of contract. Liability for items brought onto the premises is excluded unless they were handed in at the counter; lockers do not create a custody relationship.

§9 Changes to the fee and to these terms

The operator may raise the membership fee once per calendar year to offset demonstrably increased costs of energy, rent, staff or equipment. Members are informed in text form at least eight weeks in advance and may cancel with effect from the date the increase takes effect. If the member does not cancel by that date, the new fee applies.

§10 Final provisions

German law applies. If the member is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Duisburg. Should individual provisions be or become invalid, the validity of the remaining provisions is unaffected. The operator is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
